Distance Selling Agreement

DISTANCE SALES AGREEMENT

Prepared in accordance with the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts.

1. PARTIES

BUYER INFORMATION

The person placing the order (name, surname, address and contact information as stated in the order form).

2. SUBJECT OF THE AGREEMENT

This agreement regulates the rights and obligations of the parties regarding the sale and delivery of product(s) ordered electronically by the Buyer from the Seller's website www.barroniprofumo.com, in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts.

3. PRODUCT INFORMATION

The type, quantity, brand/model, color, number, and sales price of the product(s) subject to the agreement are as stated in the order summary and invoice. The basic features of the products are available on the product pages of the website.

4. PRICE AND PAYMENT

  • Product prices include VAT, and the price valid at the time of order is applied.
  • Payment can be made by credit card, debit card, or other methods offered on the website.
  • Payment is collected upon order confirmation.
  • For installment transactions, the terms and conditions of the relevant bank/financial institution apply.

5. DELIVERY

  • Products will be delivered to the address specified by the Buyer within a maximum of 30 (thirty) business days from the order date, depending on stock availability.
  • Delivery will be made through an contracted cargo company.
  • In the absence of the Buyer, the notification of the cargo company will be taken as a basis; the product will be held at the cargo branch.
  • In case of damage or incomplete delivery, the Buyer must draw up a report at the time of delivery.

6. RIGHT OF WITHDRAWAL

The Buyer has the right to withdraw from the contract without giving any reason and without paying any penalty within 14 (fourteen) days from the date of receipt of the product. (applies only to 50 ml)

Exercising the Right of Withdrawal

  • Withdrawal notification must be made via email to info@barroniprofumo.com or in writing.
  • The product must be returned within 10 (ten) days from the date of notification.
  • The return shipping cost is borne by the Buyer.
  • The payment will be refunded within 14 (fourteen) days after the product is received back.

⚠️ Exceptions to the Right of Withdrawal

The right of withdrawal cannot be exercised in the following cases:

  • Perfumery and cosmetic products with opened packaging, used, or with their seal/foil broken even for trial purposes (within the scope of hygiene and health protection)
  • Products manufactured or customized according to the special requests of the Buyer
  • Products that are prone to rapid spoilage

Important Note: Perfume products fall under the hygiene exception once their packaging is opened. Therefore, we recommend reviewing product descriptions and tester options before purchasing the product.

7. WARRANTY AND DEFECTIVE PRODUCT

  • Products are covered by a legal warranty for 2 (two) years from the date of delivery.
  • In case of delivery of a defective product, the Buyer may exercise one of the rights to demand repair, replacement, refund, or discount.
  • Defective product notification must be made to info@barroniprofumo.com.

8. PROTECTION OF PERSONAL DATA

The personal data of the Buyer is processed and protected within the scope of the Personal Data Protection Law (KVKK) No. 6698. Personal data is used for processing the order, delivery, and fulfilling legal obligations, and is shared with third parties only for these purposes. 9. DISPUTE RESOLUTION

In disputes arising from this agreement, it is recommended to first contact the Seller. In unresolved disputes:

  • Application can be made to District/Provincial Consumer Arbitration Committees (within legal monetary limits).
  • For disputes exceeding the limits, Consumer Courts are authorized.
  • Authorized courts: Kocaeli Courts and Enforcement Offices.

10. GENERAL PROVISIONS

  • The Buyer declares that they have read, understood, and accepted this agreement and the preliminary information form before placing an order.
  • This agreement is considered to have been concluded electronically with the order confirmation.
  • If the Seller cannot supply the product subject to the agreement due to force majeure or extraordinary circumstances, the Seller will notify the Buyer and refund the payment.
  • This agreement is subject to Turkish law.
